Session 1: Why Chemicals are regulated
During this session, we will explore the background to chemical regulation and how it has taken shape over the years. We will review the key drivers and influences that have resulted in the current myriad of legislation impacting the chemical sector, in order to try and understand why company activities are impacted by it. Delegates will become familiar with the language of chemical regulation, understand the difference between hazard and risk, a Directive and a Regulation, and other key terms. We will consider the use of chemicals by consumers, professional users and workers, to understand aspects of the legislation that are focused on controlling exposure.

Session 2: EU Green Deal
We will focus on the Digital Product Passport (DPP) and its impact on our industry. The links to Ecodesign for Sustainable Products Regulation (ESPR) and Extended Producer Responsibility (EPR) will be highlighted. Other thematised legislation includes Critical Raw Materials Act and Green Claims Directive.

Session 3: Specific legislation
In this session we will explore specific legislative instruments, the key principles and main requirements: The REACH Regulation – Registration, Evaluation, Restriction and Authorisation of Chemicals. We will further consider regulation in a global context, including a review of UK legislation and how it fits within the European framework.

The influence of the ‘Green Deal’ and ‘Chemical Strategy for Sustainability’ will be considered, followed by an example of sector specific legislation and enforcement.

  • - The CLP Regulation – Classification, Labelling & Packaging of Substances and Mixtures.
  • - The relationship between the CLP Regulation and the Globally Harmonised System of Classification and Labelling (GHS).
  • - The global perspective – how it fits together – aspects of EU legislation that are influenced by global regulation. A brief consideration of other countries and jurisdictions with similar or equivalent legislation.
  • - The Seveso Directive, or otherwise known as the control of major accident hazards involving dangerous substances.
  • - An overview of UK legislation. How does UK regulation fit within the context of the European legislative framework? Are there differences?
  • - The influence of the Green Deal and Chemical Strategy for Sustainability.
  • - A brief consideration of sector specific legislation, the Waste Electrical and Electronic Equipment (WEEE) Directive and sister Directive, the Restriction of the use of certain Hazardous Substances in electrical and electronic equipment (RoHS).
  • - A brief review of how legislation is enforced.
  • - The European Chemicals Agency databases and other information sources

For whom

Most in our industry are impacted by chemical regulation. Regulations can be difficult to navigate, and it is not always clear who is impacted and why. The course looks at the history of chemical regulation, how it evolved and why, focusing on the legislation that impacts the print sector and associated industries. Delegates achieve a sound understanding of sector-specific chemical regulation. It is of interest to a wide variety of employees and interested parties, including top-level management responsible for ensuring the legislation is complied with.

By whom

This course is presented by the ESMA Health, Safety and Environmental Protection Committee Chair, Elaine Campling. Elaine has many years’ experience working within the chemical industry in a regulatory managerial role. She now runs her own Chemical Compliance consultancy business and remains at the forefront of chemical legislation.
